Booking Terms and Conditions

INTRODUCTION

These are the terms and conditions under which You book your Session.  You are bound by these terms and conditions, so it is important that You read them carefully.  To agree to these terms and conditions, click "agree".  If You do not agree to these terms, do not click "agree" and do not use the Services.

In booking your Session, RSPCA acts as a sales agent for the Service Provider.

You are entering into this agreement with the Service Provider as the provider of the Service and the RSPCA as the provider of the Booking Service.

In these terms and conditions, unless a contrary intention appears:

Booking Service

means the provision of a service by which a Session is booked and paid for.

Proprietary Information

means all information such as text, graphics, images and other material (Material) used in the carrying out of the Session and includes all trademarks and copyright in all written material disseminated as an incident of your booking.

RSPCA

means the Royal Society for the Prevention of Cruelty to Animals, Queensland Incorporated ARBN 166 777 591

Service

means the provision of the services referred to in the description of the particular class noted on this website, that relates to Your booking.

Service Provider

means the Service Provider noted on the tax invoice to which Your booking relates.

Session

means the class relating to Your booking that is held or to be held by the Service Provider at a particular date, time and place.

Transaction

means a booking, amendment or cancellation of a Session(s).

We/Our/Us

means the Service Provider and where the context permits, the RSPCA.

You/Your

means the person making this booking and, where the context so permits, all attendees at the Session to which that booking relates.

BOOKINGS AND ELECTRONIC CONTRACTING

Your use of the Booking Service includes the ability to enter into agreements and/or to make Transactions electronically. You acknowledge that your electronic submissions constitute Your agreement and intent to be bound by and to pay for such agreements and Transactions. Your agreement and intent to be bound by electronic submissions applies to all Transactions You enter into by this site, including notices of cancellation, policies, contracts, and applications. In order to access and retain Your electronic records, You may be required to have certain hardware and software, which are Your sole responsibility.

You agree to provide accurate and complete information when You book a Session, and You agree to update Your information and keep it accurate and complete each time you revisit the site to make a further Transaction. You agree that We may store and use the information You provide for use in maintaining and billing Your account and for other purposes referred to under the Privacy heading of these terms and conditions.

When You first make a payment in respect of a booking, You represent to us that You have the authority from all those who are to be attendees at the Session, to accept these terms and conditions on their behalf. 

Once we have received a payment for a booking, an agreement on these terms and conditions becomes effective between You and all those for whom you have represented you have the authority to bind to these terms and conditions, the RSPCA and the Service Provider. 

LIMITATION OF LIABILITY

Certain laws such as the Competition and Consumer Act 2010 (Cth) and any applicable state-based consumer legislation (from hereon referred to as 'consumer laws'), are in place for Your protection.  Those consumer laws may imply warranties or conditions or impose obligations upon Us which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. They are designed to ensure the services provided by the RSPCA and the Service Provider are, for instance, provided with due care and skill and are reasonably fit for their intended purpose. 

These terms and conditions must be read subject to those consumer laws.

If these statutory provisions apply, to the extent to which We are entitled to do so, We limit Our liability in respect of any claim under those provisions to:

(a)           in the case of goods, at Our option: the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired; and,

(b)           in the case of services, at Our option: the supplying of the services again; or the payment of the cost of having the services supplied again.

Where it is lawful to do so, Our liability is limited to the amount paid by You at the booking to which Your claim relates.

In addition, Our liability will be reduced in proportion to any negligence or fault on Your part.

PAYMENTS

Once You have decided to book your Session(s), we will need full payment.  In the event that payment is not received at the time when the booking is made, your booking will be automatically cancelled. 

INSURANCE

We strongly recommend You purchase appropriate insurance prior to attending your Session. 

CANCELLATION, CHANGES & REFUNDS

Although we would love to see You at your scheduled Session, we understand that that plans can change. Should You need to cancel or reschedule your booked class, You will need to do so online as soon as possible prior to the commencement of your class. The refunds or cancellation charges that will be payable are dependent on the amount of notice You give Us, as follows:

If You choose to change the date on which your original class were booked to a different date or to a different location, it will be treated as a cancellation of Your original booking. In this instance, Our cancellation charges, as per the cancellation and refunds policy noted in the table above, will apply. Exceptions and adjustments to any fees or refunds will be reviewed on each Individual Clients Circumstances.

In the case of rain, your RSPCA School for Pets teacher will contact you via SMS to advise if classes have been cancelled. You can also keep an eye out on your local RSPCA School for pets Facebook page for updates regarding weather conditions and cancelled classes. Should a class need to be cancelled due to weather, it will be rescheduled.

GOOD BEHAVIOUR

For the safety and enjoyment of all participants at Your Session, You are required to ensure that any children and teenagers in your group exhibit good and appropriate behaviour at all times. 

If You or any member of Your group exhibit conduct which, in the sole determination of the Service Provider, constitutes conduct that seriously affects the safety, well-being or enjoyment of themselves or any other person attending the Session, the Service Provider has the right to cancel Your attendance at the Session and remove You from the place at which the Session is being conducted, using reasonable force.  In such cases, You will not be entitled to any refunds in respect of the Session affected by the behaviour and We may cancel the provision of any further Service to You.   The Service Provider will always act reasonably in assessing the circumstances, and You accept that the safety, well-being and enjoyment of everyone involved in the Session comes first.

INTELLECTUAL PROPERTY

You agree that the material delivered at the Sessions contain Proprietary Information and material that is owned by Us and/or Our licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright and trademark.

You agree that You will not use such Proprietary Information or materials in any way whatsoever except for a purpose that has been authorised by Us. No portion of the Proprietary Information may be reproduced in any form or by any means, except as expressly permitted. Except to the extent that applicable laws prevent Us restraining You from doing so, You agree not to modify, loan, sell, distribute, or create derivative works based on the Proprietary Information in any manner, and You shall not exploit the Proprietary Information in any unauthorized way whatsoever.

You are not granted any right or license with respect to any of the Proprietary Information outside of use incidental to your attendance at Your Session.

OTHER LEGAL MATTERS

In the unlikely event You have reason to take legal action, You agree to use all reasonable efforts to bring the issue to Our attention as soon as possible prior to commencing court action.

This agreement is governed by the laws in force in Queensland.  You agree that any action You bring against Us will be bought in Queensland.

If any provision of the terms and conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the terms and conditions which will continue in full force and effect.

We reserve the right at any time to modify this agreement and to impose new or additional terms or conditions relating to the Booking Service and/or the Service. Such modifications and additional terms and conditions will be effective immediately upon notice to You and incorporated into this Agreement. Your continued use of the Service will be deemed acceptance thereof.  If You do not wish to accept the changed terms and conditions You may cancel the balance of the Sessions to which Your booking relates and apply for a refund of the unused portion of the payment made.

PRIVACY

Privacy laws safeguard Your personal details.

During the booking process and Your Session, We ask for information about You.  We collect this information so You receive the highest level of personalised service.  After Your booking and/or Session, Your information is stored so We can inform You of any special offers or obtain feedback.  If You do not wish to receive such offers or to be contacted to provide feedback, please let Us know.  We may also be required to pass Your information onto various third parties such as other service providers and insurers. 

We do not represent or guarantee that the Booking Service will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion, and We disclaim any liability relating thereto.

We will use reasonable efforts to protect information submitted by You, but You agree that Your submission of such information is at Your sole risk, and We hereby disclaim any and all liability to You for any loss or liability relating to that information in any way.
